예전에도 비슷한 글을 쓴 적이 있지만... 요즘 같은 시대에 이런 종류의 질문은 매우 난해한 질문이 되어 버렸다.
'10억 생기면 죄짓고 1년 감옥 갈 수 있냐'는 질문에서 핵심은... 어떤 종류의 '죄'를 말하는 것인가?이다. 중범죄, 경범죄도 모드 죄에 속하지만... 세밀이 따지면 경범죄와 중범죄는 서로 하늘과 땅 차이다. 게다가 중범죄에도 종류가 많지 않은가.
질문을 살짝 바꿔보자. '1년간 엄청난(?) 혹은 상당한 수준의 선행 또는 자기희생을 한 사람에게 10억을 주는 것에 동의하는가?'라는 질문은 어떤가. 여기서도 핵심은 선행 혹은 자기희생의 ' 정도'다.
작금의 자본주의 사회에서 돈은 길이요, 진리요, 생명을 넘어 급기야 '신'이 되었다. 그런 측면에서 솔직히 말해보자. 공공의/다수의 이익을 추구하기 위해서, 나/개인의 이익 추구를 (일부 혹은 전부) 포기/수락할 수 있을까...? 매우 난해한 질문이다.
다른 질문을 해보자. 이번 한 번 (부조리와 모순과 불합리, 비정의, 불공정 등을) 모른 척 눈 감으면/회피하면/외면하면... 약간의 희생양이 있을 수도 있겠지만... 그리 큰 희생자 없이 승진도 하고, 어느 정도 이익도 생긴다면... 나는/우리는 그 부조리와 모순, 불합리, 불공정, 비정의를 모른 척, 못 본 척해도 괜찮을 것일까...?라는 질문은 어떤가.
삶에 대한 태도...? 그것은 각자의 판단 선택에 따라 좌우되는 것이지만... 현실의 실상을 보면... 그것은 쉽지 않은 논제이고, 단정하기 어려운 질문이다. 인간은 언제나 선비의 문제의식과 상인의 현실감각을 동시에 추구/보유하고 있어야 하는데... 그건 쉬운 일이 아니다.
사족: 피해자를 생각하지 않는다고 하지만... 피해자를 생각하지 않는 작금의 현실(ex: 가해지의 인권을 더 염려하는 어설픈 인권주의 및 감상주의 및 이상주의자)과 법조계/법조인(ex: 판사, 검사, 변호사, 전관예우, 판결, 기소행태 등)들을 보면... 아이들이 누구를 보고/무엇을 보고 배운 것인지 짐작할 수 있을 것이다.

I’ve written similar things before, but in today’s world, this kind of question has become extremely difficult. The core of the question “If you get 1 billion won, would you commit a crime and spend a year in prison?” is: what kind of crime are we talking about? Both felonies and misdemeanors are crimes, but the difference between them is like heaven and earth. And even among felonies, there are many different kinds.
Let’s change the question slightly: “Do you agree with giving 1 billion won to someone who has performed tremendous (or significant) good deeds or self-sacrifice for a year?” Again, the key lies in the degree of good deeds or self-sacrifice.
In today’s capitalist society, money has become the path, the truth, beyond life itself—eventually even becoming a god. From that perspective, let’s be honest: for the sake of public or majority benefit, can I/we accept giving up (partially or entirely) our personal interests? That is a very difficult question.
Here’s another one: “If, just this once, I turn a blind eye to absurdity, contradiction, irrationality, injustice, and unfairness—if I ignore or avoid them—there may be a few scapegoats, but without major victims, I could get promoted and gain some benefits. Would it be okay for me/us to pretend not to see that absurdity, contradiction, irrationality, injustice, and unfairness?”
Attitude toward life…? It depends on each person’s judgment and choice. But in reality, it’s not an easy topic, nor a question with a simple answer. Humans must always hold both the scholar’s sense of moral concern and the merchant’s sense of practical reality—but that is no easy task.
A side note: People say victims are not considered, but looking at today’s reality—where perpetrators’ rights are often prioritized by shallow human-rights advocates, sentimentalists, and idealists—and at the legal world (judges, prosecutors, lawyers, favoritism, rulings, indictments), one can guess what children are watching and learning from. Idealism and reality: “The scholar’s moral concern and the merchant’s practical sense.”
